In the case of Kirkman v DP World Melbourne Limited [2016] FWC 605 the Fair Work Commission held that an investigation report brought into existence for an employer attracted “legal professional privilege” and, as a result, was not required to be disclosed to an employee even though the decision to terminate the employee’s employment was, in part, based on findings in the report.
